A family in Limerick is facing legal consequences after a bold move to install a mobile home in their backyard. The use of a crane to lift the mobile home has sparked controversy and led to court action.
Limerick City and County Council has taken legal steps against four individuals residing at Páirc Luachra in Abbeyfeale. The case first appeared in Newcastle West Court on November 4, with the defendants accused of ignoring an enforcement notice to remove a caravan and mobile home from their council-owned property.
The notice, issued on July 4, last year, was allegedly disregarded, leading to the current legal proceedings. Solicitor Will Leahy, representing the Council, informed the court of complaints received earlier this year regarding a caravan in the front garden and a mobile home in the back garden.
He revealed that a crane was used, at a significant cost, to place the mobile home in the backyard. Solicitor Enda O'Connor, defending the accused, acknowledged the challenge of moving the mobile home and suggested it might not be feasible before the end of the year.
O'Connor requested an adjournment to assess the case materials, proposing a delay until the New Year to avoid the Christmas rush. However, Leahy expressed his willingness to proceed before Christmas.
Judge Carol Anne Coolican granted the adjournment, scheduling the case for December 2, when evidence relating to the alleged offense will be heard. This case raises questions about the boundaries of property use and the consequences of non-compliance with enforcement notices.
